Terms of Service
Welcome to Sito. These Terms of Service ("Terms") govern your access to and use of the Sito mobile application ("Sito" or the "App") operated by Invictus Logic LLC ("we," "us," or "our").
By creating an account or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. Description of the Service
Sito is a nutrition tracking application designed for parents and legal guardians to monitor and manage their children's daily nutritional intake. The App allows you to log meals, track nutrients, set nutrition goals, receive AI-powered nutrition guidance, and view your children's nutrition progress over time.
Geographic scope: The App is offered through the Apple App Store and Google Play in the United States, the United Kingdom, Ireland, Canada, Australia and New Zealand. Nothing in these Terms limits any statutory rights you have as a consumer under the law of your country.
2. Eligibility
You must be at least 18 years old to create an account and use Sito. By creating an account, you represent and warrant that you are the parent or legal guardian of any children whose information you enter into the App.
3. Account Registration
You agree to provide accurate, current, and complete information when creating your account. Each parent or guardian should maintain only one account. You are responsible for safeguarding your password and for all activities under your account.
4. Subscriptions and Payments
Sito requires a paid subscription to access features. We offer monthly and yearly plans (yearly includes a 3-day free trial). All subscriptions are billed through Apple App Store or Google Play Store. We do not collect or process payment information directly.
Subscriptions automatically renew unless cancelled before the renewal date. You can manage or cancel through your device's app store settings.
5. Acceptable Use
You may use Sito only for its intended purpose: tracking and managing nutrition for your children as a parent or legal guardian. You agree not to use the App for any unlawful purpose, attempt to access non-public areas, reverse-engineer the App, or interfere with its functionality.
You retain ownership of content you provide through the App. For personal content (such as meal photos and chat messages), you grant us a limited, non-exclusive license to use, process, and store that content solely to provide and improve the App. For product label contributions — photographs of product packaging such as barcodes, ingredient lists, nutrition facts panels, or the front of a package, and information extracted from them — you grant Invictus Logic LLC a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, host, reproduce, modify, adapt, publish, translate, distribute, and display those contributions, including in Sito's shared product database visible to other users and as contributions to third-party open food databases (such as Open Food Facts) under their applicable open licenses. Product label contributions describe factual product packaging and are not treated as personal content.
6. Health and Medical Disclaimer
Sito is not a medical application and does not provide medical advice, diagnosis, or treatment. The nutritional information, BMI calculations, nutrition targets, and AI-generated guidance are for informational and educational purposes only.
Always consult a qualified healthcare provider before making decisions about your child's diet, nutrition, or health. Nutritional data is sourced from third-party databases and may not be perfectly accurate. AI-generated suggestions may contain inaccuracies and should be verified.
You assume full responsibility for any decisions you make based on information provided by the App.
7. AI Features
Sito includes an AI-powered nutrition assistant. By using this feature, you acknowledge that your chat messages and your child's profile information are processed by third-party AI providers to generate responses. AI responses are generated automatically and are not reviewed by healthcare professionals.
8. Intellectual Property
The App, including its design, features, code, graphics, logos, and content, is the property of Invictus Logic LLC and is protected by intellectual property laws. "Sito," the Sito logo, and related marks are trademarks of Invictus Logic LLC.
If you believe content available through the App infringes your copyright, send a DMCA notice with "DMCA Notice" in the subject line that identifies the copyrighted work and the allegedly infringing material, provides your contact information, includes a good faith statement and a statement under penalty of perjury that the information is accurate and that you are authorized to act, and bears your signature. 9. Third-Party Services
The App relies on third-party services including Supabase, FatSecret, Cloudflare, Google Gemini, OpenAI, Expo, RevenueCat, PostHog, Meta and Apple/Google. We are not responsible for the availability, accuracy, or practices of these services.
Product data — the packaged foods you scan — comes from our own database, built from Open Food Facts (Open Database License), the USDA's FoodData Central, and the products parents contribute under Section 5 above. Per-serving nutrition data is supplied by FatSecret via the FatSecret Platform API; by using Sito, you agree to be bound by the FatSecret Platform API Terms of Use. 10. Data and Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information.
11. Account Termination
You may delete your account and all associated data through the App's Profile screen. We reserve the right to suspend or terminate your account if you violate these Terms. If unable to access the App, contact us at berkay@sitonutri.com.
12. Disclaimers
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INVICTUS LOGIC LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.
14. Dispute Resolution
These Terms shall be governed by the laws of the District of Columbia. Before filing any formal legal action, you agree to attempt informal resolution for at least thirty (30) days by contacting us at berkay@sitonutri.com.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App. Your continued use constitutes acceptance.
Governing language. These Terms are written in English. We publish translations for convenience only; if a translation and the English version ever disagree, the English version applies.
